TERMS AND CONDITIONS

Legally Binding Agreement.

We BS Hyera Shipping LTD are extending and offer services to you. The particular services being offered are described in more detail below. The following terms and conditions explain certain details of our offer. If you accept our offer and those terms, we will both become parties to a legally binding agreement.

 

Late Payments Charges:

BS Hyera Shipping ltd we have the right to claim interest on late payment, if you except our quote and you agree to ship/export your cargo (Vehicle,Trcks, Container etc) you agree that you will be liable for any interest apply to you / your company.

 

Terms of Payments.

We reserve the right to ask and expect a partial advance cash payment with any order unless agreement has been made to us before booking. We may stipulate payment either by lump sum or progress payments. If you offer as payments as check other than cash, such offer will not be considered a payment unless and until we are able to convert payment into cash.

 

 

Cancellations of The Agreement and Termination Costs.
If you accept quotation and we made all the necessary arrangements booking/deliver your cargo to the port of export as agreed, offer it becomes a legally binding agreement between us Bs Hyera Shipping LTD and you.

 

 

If you decide to cancel this agreement or if you fail to pay us any money you owe or agree by accept our quote by email, phone or verbal agreement under this agreement, or if you fail to fulfil any of your promises you made by accepting this agreement, we may treat the order as having been terminated by you.

 

 

If you terminate the order and cargo already reached port of export choosen by you, you agree to pay us an amount to compensate us for the damages we incurred as a result of your terminating the order/cargo to be exported, you agree that our damages, for which you will be liable as below,

 

(a) If you terminate agreement while your cargo reached port of export or for cargo already booked to the shipping liner ready to be shipped you agree to pay 10% of cancellation fees plus administrations fees and all direct labour of agreed quotation by you and all additional direct or incidental costs resulting from termination of the order for every items/cargo e.i. truck, vehicle, trailer etc arranged/booked by Bs Hyera Shipping LTD as agreed by you.

 

(b) Any costs incurred by us, i.e. purchased/transportation/booking arrangements and export arrangements of your cargo reasonable profit on the work completed or work in progress at the time of order termination.

 

 

(e) The nominal administrative costs to process termination of an order.

If you refuse to pay us the damages for which you are liable, you agree that we may collect from you any incidental expenses we may incur in recovering the damages from you, including court costs, attorneys' fees, and any other incidental expenses authorised under the laws governing.

Any goods, for which payment has cleared, including any applicable charges for freight and packing, will be available for delivery to you. If you fail to claim the goods or accept of being notified that they are available, you will be responsible for storage charges at a rate customarily charged by freight companies for demurrage based on the storage space required.

 

You agree that we may cancel any order or require full or partial payment in advance by you, even if you were not otherwise required to make advance payment under our agreement, if you file for bankruptcy, if your solvency is in question, or if a trustee or receiver is appointed for you.

 

Responsibility for Taxes, Duties, Excises and License Fees.

The amount of any and all present taxes, duties, excises, license fees and other charges applicable to goods sold or shipped will be the responsibility of you.

 

 

Delays Beyond Our Control, Estimated Shipping Dates.

(a)You agree that BS Hyera Shipping LTD not be held responsible for any loss or damages resulting from any delay or failure to make delivery due to damages to the equipment, machinery, heavy cargo, vehicles, containers or any materials occurring in transit.

 

(b)You agree that we will not be held responsible for any loss or damages resulting in a delay or failure to make delivery because of priorities or other regulations or orders of any UK governmental authority and UK authority agency.

 

(c)You agree that we will not be held responsible for any loss or damages resulting in a delay or failure to make delivery due to a failure to obtain labour, a labour dispute, riot, or any other cause outside our control.

 

(d)The same above will apply whether any of the events just described (c) affected us directly or affected one or more of our suppliers or shipping liner and our business partners.
